Qustodio License and Terms of Service
Last Updated: [5th November], 2026
IMPORTANT: PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING THE SERVICES WE PROVIDE (AS DEFINED BELOW), AS THESE TERMS CONSTITUTE A BINDING CONTRACT BETWEEN US.
Thanks for choosing Qustodio. We help families create a safer digital environment for their children by making parental controls and digital-wellbeing tools simple to understand and easy to use. For the purposes of this License and Terms of Service (collectively, “Terms”), “Qustodio”, “We” or “Us” means Qustodio Technologies, S.L.U., an Aura company. Your country of residence is determined as of the date you most recently accepted these Terms. To make it easier to understand, we’ve divided our legal terms into five parts: (1) Automatic Renewals and Billing, (2) General Legal Terms, (3) Service-Specific Terms, (4) License Terms, and (5) Additional Terms for EU, EEA, and UK Residents.
We want to highlight a few important points about these Terms:
1. These Terms represent a binding contract between you (“You”) and Qustodio. These Terms apply to your use of any products or services offered by Qustodio as described in these Terms (collectively, the “Services”), including all software provided as part of our Services (the “Software”), whether through the website found at https://www.qustodio.com/, a mobile or desktop application, or in any other manner.
2. You agree to be bound by these Terms when you sign up for or use the Services, download or use any Software in connection with the Services, and any time you access or use the Services. We encourage you to read our Terms carefully. If you do not agree to be bound by these Terms, you should not use the Services.
3. You represent you have read and accept the Qustodio Family Privacy Policy available here, the terms of which are an integral part of these Terms of Service.
4. IN PARTICULAR, THESE TERMS CONTAIN AN ARBITRATION AGREEMENT THAT REQUIRES U.S. USERS TO RESOLVE DISPUTES WITH QUSTODIO OR THE QUSTODIO ENTITIES (DEFINED IN SECTION 2.8) THROUGH ARBITRATION ON AN INDIVIDUAL BASIS. ARBITRATION ON AN INDIVIDUAL BASIS MEANS THAT YOU WAIVE THE RIGHT FOR A JUDGE OR JURY TO DECIDE YOUR CLAIMS, AND THAT YOU MAY NOT PROCEED IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE CAPACITY. SEE SECTION 2.12 BELOW FOR THE DETAILS OF THE ARBITRATION AGREEMENT.
This Part 1 does not apply to you to the extent you receive the Services at no charge or through a reseller, carrier, or bundled arrangement described in Section 1.6, in which case the applicable terms in Section 1.6 govern billing and cancellation.
1.1 Subscription and Enrollment. Depending upon the Services you subscribe or register to use, you may be permitted to enroll as follows: (1) by the Qustodio website, (2) through a mobile or desktop application or app store, (3) by another method permitted by Qustodio, or (4) by a third party who is authorized on Qustodio’s behalf to enroll you or provide your personal information to enroll you on your behalf. Our Services are generally billed on a subscription basis (“Subscription”). If applicable and you elect to enroll in a Subscription, you will be billed in advance for your Subscription on a recurring and periodic basis (“Billing Cycle”). The length of your Billing Cycle will depend on the Subscription you select (“Subscription Term”). You agree to pay for the Subscription that you select. You also authorize us to automatically charge the payment method our service provider has on file based on the Billing Cycle applicable to your Subscription.
1.2 Automatic Renewals and Cancellation. At the end of each Billing Cycle, your Subscription will automatically renew for an additional Billing Cycle at the price shown in your account dashboard or otherwise communicated to you by us pursuant to Section 1.5 (“Renewal Price”) unless you or we have canceled your Subscription prior to the commencement of your next Billing Cycle in accordance with Section 2.17 below. We will notify you in advance, as required by applicable law, that your Subscription is due for renewal and make the Renewal Price available in your account dashboard. You may cancel your Subscription at any time by logging into your account and following the cancellation flow, or by contacting us at support@qustodio.com. Once we or you have canceled your Subscription, your recurring subscription fees for the Services will no longer be charged to the payment method our service provider has on file for your account, and your Subscription will remain active only until the end of the current Billing Cycle. Except as expressly provided in these Terms or required by applicable law, Qustodio is under no obligation to provide you any refund if you cancel your Subscription early.
1.3 Plan Switching. In the event we allow you to switch your Qustodio Subscription plan, we will confirm the plan change and reflect any Service Credits (as defined in Section 1.7) or amount owed due to the difference in changing plans, and the Billing Cycle for the new plan. Your plan switch will be effective as of the date shown in your account profile and confirmation, which will generally be tied to the date you elect to switch your plan.
1.4 Payment Methods. A valid payment method is required to process the payment for your Subscription. You shall provide us or our third-party payment processor with accurate and complete billing information, which may include full name, address, state/province/territory, zip/postal code, and valid payment method information. By submitting such payment information, you automatically authorize us to charge all Subscription fees incurred through your account to any such payment instruments.
Unless we expressly provide otherwise, or as required by applicable law, all amounts paid are non-refundable. You further agree to be responsible for any applicable state/provincial/territorial, federal, or other taxes that may be associated with the Services, including sales taxes and VAT or equivalent, along with any transaction fees and currency conversions added by your financial institution and intermediaries. Applicable taxes will be displayed or otherwise disclosed to you at the point of purchase where required by law.
If the billing method you provide is a credit or debit card (“Payment Card”), you:
1) represent that you are authorized to use such Payment Card;
2) authorize us to charge your Payment Card periodically for the Subscription fees when due, including upon sign up for the Services and each subsequent Billing Cycle;
3) agree to keep your Payment Card details valid and current; and
4) agree to pay any processing fees that are charged by the third-party payment processors or Payment Card issuer.
If your Payment Card is declined when we attempt to charge it, we may try to charge it again at a later time. If we do not receive payment, we may suspend or terminate your Subscription.
1.5 Fee Changes. We may change the fees that we charge for the Services at any time at our sole discretion, provided that we will give you at least thirty (30) days of prior notice of such changes. Unless otherwise specified in such notice to you, any changes to the Subscription fees will take effect in the next Billing Cycle immediately following our notice to you. If you do not agree to a fee change, you may cancel your Subscription in accordance with Section 1.2 before the change takes effect; your continued use of the Services after the effective date constitutes acceptance of the new fees.
1.6 Obtaining Qustodio through Authorized Resellers, Carriers, and Partners. If you enrolled in our Services through a reseller, mobile carrier, retailer, or other authorized partner (each, a “Reseller”) rather than directly with Qustodio, the following terms apply: No refunds are provided by Qustodio for Services purchased through a Reseller. The Services will continue to be accessible until the last day of your current Billing Cycle. Your billing, renewal, and cancellation are governed by your agreement with the Reseller, and you must contact the Reseller to cancel the Services. Any disposition of refunds, if owed, is between you and the Reseller.
1.7 Service Credits. At any time, and for any reason, we may provide you with credits that are redeemable for our Services (“Service Credits”). Unless otherwise required by applicable law, Service Credits are not legal tender or currency; are not redeemable, refundable, or exchangeable for any sum of money or monetary value; have no equivalent value in fiat currency; do not act as a substitute for fiat currency; and do not constitute or confer upon you any personal property right. Service Credits are non-transferable and may be used only in connection with the Services. Service Credits are not refundable and expire one year after the date of purchase or issuance if not used, unless otherwise specified at the time of purchase.
2.1 Access and Eligibility. To use our Services, you must be Eligible, establish a user account, and (for paid features) enroll in a Subscription to the Services. In order to access and use certain Services, you may be required to download and install our Software on a device. “Eligible” means that you are at least 18 years of age or the age of majority in your jurisdiction of residence, whichever is greater. Because the Services are parental-control and family-safety tools that are configured and administered by an adult, the account holder must be an adult parent or legal guardian (or another adult with lawful authority over the applicable device or user). By downloading, using, or accessing the Services, you represent and warrant that you are Eligible. Our Services are not available to any users previously suspended, terminated, or removed from the Services by Qustodio.
If Qustodio does not receive all the required information necessary to provide the Services during the enrollment process, you agree that we may be unable to provide some or all of the features in the Subscription plan you selected and cancel the Services.
2.2 User Data, Accounts and Passwords. You are fully and solely responsible and liable for the content and data you enter into our Services, including your user name and password. You are solely responsible for ensuring that you keep your user name and password safe. You agree not to disclose your password to any third party and must notify us immediately of any unauthorized use of your account. We are not responsible for your failure to do so, or for any delay in suspending or terminating your account after you do. You are responsible for all use of your account. We may reject, or require that you change, any user name or password, in our sole discretion.
2.3 User Submissions and Feedback. If you provide to Qustodio, either directly or through a third party such as an app store, feedback, reviews, suggestions, comments, or ideas relating to the Services (“Submissions”), you grant, to the maximum extent permitted by applicable law, Qustodio and its affiliated companies a royalty-free, perpetual, irrevocable, worldwide, unlimited, nonexclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the Submission in any media or medium now known or hereafter developed, to improve or market the Services or for any other reasonable business purpose. We may sublicense these rights through multiple tiers of sublicenses. No compensation will be paid with respect to the use of your Submission. Qustodio is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in its sole discretion and without notice. By providing a Submission, you represent and warrant that you own or otherwise control all rights necessary to provide it, including Intellectual Property Rights (meaning all patent, copyright, trademark, trade secret, database, moral, and other intellectual property or proprietary rights worldwide, whether registered or unregistered), and that the Submission is accurate, is not false or misleading, does not infringe or violate any third party’s rights, does not violate any applicable law, was not provided in exchange for consideration from any third party, does not include personal information of any other person, and does not contain any harmful code. Submissions shall not be deemed confidential.
2.4 Beta Features and Updates. We may, in our sole discretion, include new and/or updated beta features in the Services for your use. You understand and agree that your use of beta features is voluntary and at your own risk, and that beta features are provided on an “as is” basis. We may from time to time develop and provide updates for the Services, including upgrades, bug fixes, patches, and new or modified features (collectively, “Updates”). Updates may also modify or delete features in their entirety. If you do not download and install the most recent Updates, portions of the Services may not properly operate. All Updates will be deemed part of the Services and subject to these Terms. You agree that Qustodio has no obligation to provide any Updates or to continue to provide or enable any particular features.
2.5 Free Versions and Free Trials. Qustodio may, in its sole discretion, offer (a) a version of the Services with limited features at no charge (a “Free Version”), or (b) a paid Subscription that begins with a free introductory period (a “Free Trial”) (each, a “Free Offering”). The specific terms of any Free Offering, including its features, duration, and eligibility requirements, will be provided at signup and/or in the applicable promotional materials, and your use of the Free Offering is subject to those specific terms and these Terms. We reserve the right to modify, suspend, or discontinue any Free Offering at any time, subject to applicable law.
(a) Free Versions. A Free Version is provided at no charge, does not require you to provide payment information, and will not automatically convert into a paid Subscription. A Free Version may include fewer features, Devices, or users than a paid Subscription. You may upgrade from a Free Version to a paid Subscription at any time, in which case Part 1 will apply to your paid Subscription from the date of upgrade.
(b) Free Trials. A Free Trial gives you temporary access to a paid Subscription for the trial period stated at signup. Free Trials may be limited to users who have not previously received a Free Trial within a defined period. You may be required to provide your billing information to start a Free Trial, but you will not be charged during the trial period. UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE TRIAL PERIOD BY LOGGING INTO YOUR ACCOUNT AND FOLLOWING THE CANCELLATION FLOW, YOUR FREE TRIAL WILL AUTOMATICALLY CONVERT INTO A PAID SUBSCRIPTION AND YOU WILL BE CHARGED THE APPLICABLE SUBSCRIPTION FEES FOR YOUR FIRST BILLING CYCLE, which will then renew in accordance with Section 1.2.
2.6 Links to Third-Party Websites and Products. The Services may provide hyperlinks to third-party websites, resources, or services (“Third-Party Content”). You acknowledge and agree that Qustodio is not responsible or liable for the availability, terms, practices, or content of such websites, resources, or services, and that links do not imply any endorsement by Qustodio. If you choose to access or use any Third-Party Content, your personal information may be available to a third-party provider, and these Terms will not apply to your activities or any information you disclose while using third-party products or services. How third parties handle your personal information is governed by their own policies, not ours. Under no circumstances shall we be held responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused in connection with the use of or reliance on any Third-Party Content.
2.7 Data from Third-Party Services and Products. Some features may enable you to share your or your child’s data with a third-party service or product (“Third-Party Service Data”) with Qustodio, or enable Qustodio to access said Third-Party Service Data. By sharing or enabling access, you represent and warrant that you own this information or otherwise have the right to provide it to us or enable our access to it. You acknowledge and agree that you, not Qustodio, are responsible for compliance with any terms or conditions associated with the Third-Party Service Data, and under no circumstances shall we be held responsible or liable for any loss or damage caused or alleged to have been caused due to your failure to comply with any such third-party terms.
2.8 Indemnification. To the fullest extent permitted by law, you agree to indemnify and hold Qustodio, its affiliates, parents (including both Family Zone, Inc. and Aura Consolidated Group and its subsidiaries and affiliates) agents, suppliers, vendors, contractors, resellers, third-party partners, and licensors, and each of their respective contractors, subcontractors, officers, directors, shareholders, employees, agents, and third-party suppliers, licensors, and partners (collectively, the “Qustodio Entities”) harmless from any claims, losses, damages, liabilities, including legal fees and expenses, arising out of your access to or use of the Services, your violation of these Terms, or your violation of any rights of a third party (including any monitored user). Qustodio reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify the Qustodio Entities, and you agree to cooperate with our defense of these claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.
2.9 Export. The Services, or certain portions thereof, may be subject to United States and other export controls. You may not export or re-export any aspect of the Services without (a) the prior written consent of Qustodio, (b) complying with any applicable export control laws, and (c) obtaining all appropriate permits and licenses. In any event, you may not remove or export, or allow the export or re-export of, any part of the Services in violation of any restrictions, laws, or regulations of the United States Department of Commerce, the United States Department of the Treasury Office of Foreign Assets Control (“OFAC”), or any other United States or foreign agency or authority. You represent and warrant that (i) you are not located in, and will not use the Services in, any country or territory subject to a comprehensive U.S. or other applicable government embargo or sanctions; and (ii) you are not identified on any U.S. or other applicable government list of prohibited or restricted parties. If Qustodio determines, in its sole discretion, that it cannot provide the Services in a compliant manner to you, you shall not be provided access to the Services.
2.10 Disclaimers; No Warranties. TO THE FULLEST EXTENT PERMITTED UNDER LAW, SAVE FOR THE RIGHTS GRANTED TO CONSUMERS UNDER APPLICABLE LAWS, QUSTODIO DISCLAIMS ALL WARRANTIES, STATUTORY, EXPRESS, OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS. No information, whether oral or written, obtained by you from Qustodio or through the Services will create any warranty not expressly stated herein. You expressly agree that the use of the Services is at your sole risk. The Services and any data, information, third-party software, services, or applications made available in conjunction with or through the Services are provided on an “as is”, “as available”, and “with all faults” basis and with no assurances that the Services will withstand attempts to evade security mechanisms or that there will be no cracks, bugs, disablements, or other circumvention. Qustodio does not warrant that the Services will be uninterrupted or free of errors, viruses, or other harmful components, or that any of the foregoing will be corrected. When using the Services, information will be transmitted over a medium that is beyond the control and jurisdiction of Qustodio and its partners; accordingly, Qustodio assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with the use of the Services.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR CERTAIN DISCLAIMERS, SO SOME OF THE ABOVE EXCLUSIONS AND TERMS MAY NOT APPLY TO YOU. CONSUMER RIGHTS MAY VARY FROM ONE JURISDICTION TO ANOTHER. TO THE EXTENT YOU MAY HAVE CERTAIN RIGHTS UNDER APPLICABLE LAWS IN YOUR JURISDICTION, NOTHING IN THESE TERMS IS INTENDED TO AFFECT THOSE RIGHTS, IF THEY APPLY.
2.11 Limitation of Liability and Damages. TO THE FULLEST EXTENT PERMITTED UNDER LAW, QUSTODIO AND THE QUSTODIO ENTITIES WILL HAVE NO OBLIGATION OR LIABILITY (WHETHER ARISING IN CONTRACT, WARRANTY, TORT, INCLUDING NEGLIGENCE, PRODUCT LIABILITY, OR OTHERWISE) FOR ANY DAMAGES OR LIABILITIES, INCLUDING DIRECT, INCIDENTAL, INDIRECT, SPECIAL, OR CONSEQUENTIAL (INCLUDING ANY LOSS OF DATA, REVENUE, OR PROFIT, OR DAMAGES ARISING FROM PERSONAL INJURY OR WRONGFUL DEATH) ARISING CONCERNING YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION APPLIES TO DAMAGES ARISING FROM (i) USE OF OR INABILITY TO USE THE SERVICES, (ii) COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES, (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS BY THIRD PARTIES, (iv) THIRD-PARTY CONTENT MADE AVAILABLE TO YOU THROUGH THE SERVICES, OR (v) ANY OTHER MATTER RELATING TO THE SERVICES. THE AGGREGATE LIABILITY OF THE QUSTODIO ENTITIES TO YOU, IN ANY EVENT, IS LIMITED TO THE AMOUNT WHICH YOU HAVE PAID QUSTODIO FOR THE SERVICES IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY. THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN QUSTODIO AND YOU. THE TERMS OF THIS SECTION SHALL SURVIVE ANY TERMINATION, CANCELLATION, OR EXPIRATION OF THESE TERMS.
WE ACKNOWLEDGE THAT CERTAIN JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, AND AGREE THAT, TO THE EXTENT YOU HAVE ADDITIONAL RIGHTS UNDER THE APPLICABLE LAWS OF YOUR JURISDICTION, CERTAIN OF THESE TERMS MAY NOT APPLY TO YOU AND THESE TERMS ARE NOT INTENDED TO AFFECT YOUR APPLICABLE RIGHTS.
2.12 Dispute Resolution by Binding Individual Arbitration. Most customer concerns can be resolved quickly and to the customer’s satisfaction by contacting us at support@qustodio.com. If customer service is not able to resolve your concern to your satisfaction, you agree to give us a fair opportunity to resolve any complaint, claim, or dispute you may have informally, and shall provide us with a written notice of your claim in the manner described in the Notices; Contact Us section, so that we can try to address the matter amicably prior to engaging in any formal dispute resolution proceedings.
If you are a United States resident and customer service is unable to resolve a complaint you may have with Qustodio or any Qustodio Entities to your satisfaction (or if Qustodio and/or its service provider(s) have not been able to resolve a dispute with you after attempting to do so informally), you, on the one hand, and Qustodio and the Qustodio Entities, on the other, each agree to resolve those disputes under the Arbitration Agreement contained in this Section 2.12. The Arbitration Agreement requires you to resolve all disputes (other than those expressly exempted in this Section 2.12) through binding arbitration on an individual basis, instead of in courts of general jurisdiction. Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, allows for more limited discovery than in court, and is subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. Any arbitration under these Terms will take place on an individual basis; class arbitrations and class actions are not permitted. However, in arbitration, you and Qustodio and/or its service provider(s) will each be entitled to recover attorneys’ fees to the same extent they would be available in court.
Arbitration Agreement
(a) Applicability. The Arbitration Agreement in this Section 2.12 applies only if you reside in the United States or its territories.
(b) Mandatory Arbitration of Disputes. To the fullest extent permitted by applicable law, Qustodio and you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Services (collectively, “Disputes”), will be resolved solely by binding, individual arbitration and not in a class, representative, or consolidated action or proceeding. You and Qustodio agree that the U.S. Federal Arbitration Act governs the interpretation and enforcement of these Terms, and that you and Qustodio are each waiving the right to a trial by jury and the right to participate in a class action. The parties further agree that, in order to bring a claim in arbitration, they must first be able to satisfy the federal standing requirement under Article III of the United States Constitution with respect to their claim, and that the arbitrator shall be empowered to make a binding determination on standing. This arbitration provision shall survive termination of these Terms.
(c) Exceptions. As limited exceptions to Section 2.12(b) above: (i) we both may seek to resolve a Dispute in small claims court if it qualifies; and (ii) we each retain the right to seek injunctive or other equitable relief from a court to prevent (or enjoin) the infringement or misappropriation of our intellectual property rights.
(d) Conducting Arbitration and Arbitration Rules. The arbitration will be conducted by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (the “AAA Rules”) then in effect, except as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879. A party who wishes to start arbitration must submit a written Demand for Arbitration to AAA and give notice to the other party as specified in the AAA Rules.
(e) Location and Authority. Any arbitration hearings will take place in the county (or parish) where you live, unless we both agree to a different location. The parties agree that the arbitrator shall have exclusive authority to decide all issues relating to the interpretation, applicability, enforceability, and scope of this arbitration agreement.
(f) Arbitration Costs. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Rules, and we won’t seek to recover the administration and arbitrator fees we are responsible for paying, unless the arbitrator finds your Dispute frivolous. Both you and Qustodio will be entitled to recover attorneys’ fees to the same extent they would be available in court.
(g) Injunctive and Declaratory Relief. Except as provided in Section 2.12(c) above, the arbitrator shall determine all issues of liability on the merits of any claim asserted by either party and may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that party’s individual claim. To the extent that you or we prevail on a claim and seek public injunctive relief, the entitlement to and extent of such relief must be litigated in a civil court of competent jurisdiction and not in arbitration, and litigation of any issues of public injunctive relief shall be stayed pending the outcome of the merits of any individual claims in arbitration.
(h) Class Action Waiver. YOU AND QUSTODIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, if the parties’ Dispute is resolved through arbitration, the arbitrator may not consolidate another person’s claims with your claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this Dispute Resolution section shall be null and void.
(i) Severability. With the exception of the Class Action Waiver in Section 2.12(h), if an arbitrator or court of competent jurisdiction decides that any part of these Terms is invalid or unenforceable, the other parts of these Terms will still apply.
2.13 Prohibited Conduct. BY USING THE SERVICES YOU AGREE NOT TO:
1) use the Services for any fraudulent, harassing, or abusive purpose, or to damage or cause risk to our business, reputation, employees, subscribers, facilities, or any person;
2) use the Services for any illegal purpose, or in violation of any local, state/provincial/territorial, national, or international law, including laws relating to privacy, interception of communications, data protection, and the rights of children;
3) use the Services to monitor, track, or collect information about any person other than a minor child or other individual for whom you are the parent, legal guardian, or otherwise have lawful authority and any legally required consent to monitor;
4) use the Services for any commercial, professional, or educational use, it being understood that the Services are for personal, non-commercial, family use only;
5) use the Services if you are not Eligible;
6) interfere with, disrupt, damage, or deny service to the Services or any network, computer, node, account, or system connected to the Services, by any means, including by uploading or disseminating viruses, adware, spyware, worms, or other malicious code, or attempt to gain unauthorized access to any of the foregoing;
7) obtain, export, move, or copy any data, information, or material when you do not have the right to do so;
8) impersonate any person or entity, engage in sender address falsification, forge anyone else’s signature, or perform any other similar fraudulent activity; or
9) upload, post, publish, transmit, reproduce, create derivative works of, or distribute any information or material that infringes any proprietary right, or that is confidential, libelous, defamatory, obscene, pornographic, abusive, indecent, threatening, harassing, hateful, offensive, or otherwise unlawful.
2.14 No Medical Advice. You acknowledge and agree that we are not providing any medical advice by providing the Services to you. Any alerts, insights, scores, classifications, or recommendations produced by the Services (including any produced by AI Features, as defined in Section 2.21) are provided for informational purposes only and are not a substitute for your own judgment or the services of a qualified professional.
2.15 Additional Applicable Terms.
1. General. Certain areas, features, or functionality of the Services may be subject to different or additional terms, rules, guidelines, or policies (“Additional Rules”), and not every Subscription will include the same features (for example, a Subscription purchased via an authorized third party may not include all of the same features as a Subscription purchased directly from Qustodio). Not all features may be available on all devices or platforms. We may provide such Additional Rules to you via postings, pop-up notices, links, or other means at the time you access or use the relevant feature. In the event of a conflict between these Terms and the Additional Rules, the Additional Rules will control. Any reference to the “Terms” includes the Additional Rules.
2. Additional License Terms for the Apple App Store. If the Software is provided to you through Apple Inc. (together with its affiliates, “Apple”), the following apply in addition to all other terms herein: (a) Apple is not responsible for the Services and has no obligation to furnish any maintenance or support for the Software or the Services; (b) in the event of any failure of the Software to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Software (if any) to you, and, except for the foregoing and to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever for the Software; (c) any claim in connection with the Software related to product liability, a failure to conform to applicable legal or regulatory requirements, or claims under consumer protection or similar legislation is governed by these Terms, and Apple is not responsible for such claim; (d) any third-party claim that the Software or your possession and use of the Software infringes that third party’s Intellectual Property Rights will be governed by these Terms, and Apple will not be responsible for the investigation, defense, settlement, and discharge of such claim; and (e) Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
3. Additional License Terms for the Google Play Store. If the Software is provided to you through the Google Play Store (“Google-Sourced Software”), then the following apply in addition to all other terms herein: (a) you acknowledge that these Terms are between you and Qustodio only, and not with Google, Inc. (“Google”); (b) your use of Google-Sourced Software must comply with Google’s then-current Google Play Store Terms of Service; (c) Google is only a provider of the store where you obtained the Google-Sourced Software; (d) Qustodio, and not Google, is solely responsible for its Google-Sourced Software; (e) Google has no obligation or liability to you with respect to Google-Sourced Software or these Terms; and (f) you acknowledge and agree that Google is a third-party beneficiary to these Terms as they relate to Qustodio’s Google-Sourced Software.
4. Other Stores. If our Software is downloaded from any other store, platform, or marketplace, you acknowledge that you have read, understood, and agree to the customer terms of use of such store, platform, or marketplace. Qustodio is the licensor of the Software and the provider of the Services, and any third party operator of the store, platform, or marketplace is not a party to these Terms.
2.16 Privacy. We respect your privacy and have taken specific steps to help protect it. Your submission of personal information through the Services is governed by our Privacy Policy. By participating in the Services, you acknowledge that you have reviewed and understand our Privacy Policy and consent to the practices described in that policy.
2.17 Cancellation.
1. Cancellation by Qustodio. Qustodio may terminate your use of the Services or discontinue providing access at any time and for any reason, including any actual or suspected breach by you of these Terms or any other unacceptable or objectionable use of the Services, as determined by Qustodio in its sole discretion. You agree that any termination may be effected without prior notice (except where notice is required by applicable law) and that Qustodio will not be liable to you or any third party for any such termination. All refunds are issued at Qustodio’s sole discretion, except as expressly provided in these Terms or required by applicable law.
2. Cancellation by You. You may cancel your Subscription at any time, but please note that, except where a refund is expressly provided under these Terms or required by applicable law, such cancellation will be effective at the end of your then-current Subscription period, and the Services will remain available to you until the end of that period. Deleting your account (or requesting deletion), uninstalling or deleting the Software or app, removing a child or device, or leaving or ending a family plan does NOT cancel a paid Subscription or stop recurring charges.
3. Termination of these Terms. Upon cancellation or termination of the Services by either you or Qustodio, these Terms shall terminate except as set forth in Section 2.24 (Survival).
2.18 Interruptions of the Services and Force Majeure. Due to the nature of the Services, actual coverage, speeds, server locations, and quality of the Services may vary. We aim to improve and provide the Services at all times, but operation of the Services depends on the internet and third-party internet connections, equipment, or infrastructure, as well as third-party service providers. From time to time, the Services may be unavailable without prior notice or liability, including when (a) we test, update, expand, add, or remove Services or features, including those required to reflect changes in relevant laws and regulatory requirements; (b) we experience temporary interruptions due to technical difficulties, maintenance, or human errors; or (c) a Force Majeure Event causes interruption to the Services. Neither party will be responsible or have any liability for any delay or failure to perform to the extent caused by causes beyond a party’s reasonable control (“Force Majeure Event”), which may include natural disaster, pandemic, sanctions, embargoes, strikes, labor disturbances, civil unrest, acts of terrorism or criminal activity, war, failure or interruption of the internet or related infrastructure, power failures, or acts or orders of civil and government authorities; provided that each party will use reasonable efforts to limit the resulting delay or failure and the foregoing shall not alleviate any applicable payment obligations to the extent of the applicable law.
2.19 Trademark and Copyright. © 2026 Qustodio. All rights reserved. “QUSTODIO” (and combinations thereof) are trademarks and/or registered trademarks of Qustodio Technologies, S.L.U. and/or its affiliates. Other trademarks are trademarks of their respective owners. All aspects of the Services and their content, features, and functionality are owned by Qustodio, our licensors, or other content suppliers, and are protected by copyright and other intellectual property laws. See Part 4 of these Terms for the details of the limited license under which you are permitted to use the Services.
2.20 Account Data and Usage Data.
1. Account Data and Licenses. You hereby grant Qustodio a worldwide, revocable, non-exclusive, royalty-free, sublicensable, and transferable license and all other rights required or necessary to reproduce, distribute, publicly display, publicly perform, create derivative works of, and otherwise use, modify, and exploit your Account Data for the following purposes (“Permitted Uses”): (i) consistent with these Terms and as required to perform our obligations and provide the Services; (ii) in accordance with our Privacy Policy; (iii) as authorized or instructed by you; (iv) as required by law; or (v) for legal, safety, or security purposes. “Account Data” means electronic data and information submitted by you to the Services or collected and processed by Qustodio for you as a result of your use of the Services, excluding Usage Data. Account Data may include personal data and, for the parental-control Services, data collected from Monitored Devices as described in Part 3 and the applicable Privacy Policy.
2. Usage Data. Qustodio owns all rights, title, and interest in and to telemetry data, product usage data, diagnostic data, and similar data (“Usage Data”) that Qustodio collects or generates in connection with your use of the Services.
2.21 Artificial Intelligence Features.
1. Overview. Certain features and functionality of the Services use artificial intelligence, machine learning, and related technologies, including generative and agentic systems (collectively, “AI Features”), such as social monitoring and gaming voice alerts. Not all Services or features use AI Features, and the AI Features available to you depend on your Subscription and the device and platform you use. This Section 2.21 applies to all AI Features across the Services and is in addition to any applicable Service-Specific Terms in Part 3.
2. Outputs. “AI Output” means any content, insight, summary, narrative, score, classification, recommendation, alert, or other material generated by an AI Feature. AI Output is generated, in whole or in part, by processing data that may be owned or controlled by Qustodio, by you, by other members of your plan, or by third parties (including third-party data sources and AI model providers), and may be produced using AI models that are not owned by Qustodio or by you. Accordingly, and notwithstanding any other provision of these Terms or any default rule that might otherwise apply, Qustodio does not grant, assign, or convey to you any ownership interest in any AI Output. As between you and Qustodio, all right, title, and interest in and to the AI Output, the AI Features, and the underlying models, software, and Materials (as defined in Section 4.1) remain with Qustodio and its licensors, subject to the rights of third-party data sources and model providers. Subject to your compliance with these Terms, Qustodio grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use AI Output solely for your own personal, non-commercial use and only for the permitted purposes described in Section 2.21.4, consistent with the license granted in Part 4. Qustodio reserves all rights not expressly granted.
Any guidance or alert produced by AI Features is provided solely as information for your independent evaluation and review; the final decision regarding any subsequent action, including any parenting or supervision decision, remains entirely with you.
3. No Warranty; Accuracy; No Reliance. AI Features are inherently probabilistic. An AI Output generated by automated systems may be inaccurate, incomplete, out of date, or otherwise unreliable, and may not reflect the actual circumstances of your child or household. AI Output does not represent Qustodio’s advice, opinion, or endorsement and is provided for informational purposes only. AI Outputs are not, and should not be relied upon as, medical, legal, tax, financial, psychological, or other professional advice. The AI Features are not a substitute for your own judgment, your active supervision of your child, or the services of a qualified professional. You should independently verify an AI Output before relying or acting on it, and you should not rely solely on any AI Feature to detect or prevent exposure to harmful content, contact, conduct, or other risks to a child.
4. Permitted Purposes; Acceptable Use. AI Features are made available solely for parental controls, online child safety and digital wellbeing, content filtering and classification, screen-time management, location and activity monitoring, and other purposes we expressly designate. In addition to the restrictions in Sections 2.13 and 4.3, you agree not to: (i) use AI Features or AI Outputs for any commercial purpose or to make or inform eligibility decisions about any person (including decisions relating to credit, insurance, employment, housing, or education); (ii) use AI Features or AI Output to develop, train, or improve any competing product, model, or service; (iii) attempt to reverse engineer, extract, or discover the models, prompts, parameters, or training data underlying the AI Features; (iv) input or submit data that you do not have the right to provide, or use AI Features in violation of any third-party rights or applicable law, including with respect to any monitored user; or (v) rely on an AI Output in a manner that could foreseeably result in harm to you or others. We may modify, limit, suspend, or discontinue any AI Feature, or your access to it, at any time and without liability.
2.22 Notices; Contact Us.
1. Notices. All notices must be in writing and will be deemed given when: (a) personally delivered; (b) verified by a written receipt, if sent by postal mail with verification of receipt service or courier; (c) received, if sent by postal mail without verification of receipt; or (d) verified by automated receipt or electronic logs if sent by email, provided that no bounce or other technical error message was received in response. Notices to Qustodio must be sent to support@qustodio.com, marked to the attention of the Legal Department, with a copy emailed to legal@aura.com. Email alone is insufficient for providing non-routine legal notices to Qustodio, such as notices related to disputes or arbitration, indemnification claims, breach notices, and termination notices. You may grant approvals, permissions, extensions, and consents by email. Notices to you may be sent to the email address associated with your account for the Services. You consent to receive certain electronic communications from us in connection with your use of the Services, and you agree that any notices or other communications sent to you electronically will satisfy any legal notice requirements. You must keep the contact details associated with your account current and accurate.
2. Contact Us. If you have any questions about these Terms, please contact us at support@qustodio.com or via the phone number or email address in your account dashboard.
2.23 Governing Law / Jurisdiction.
1. U.S. residents. If you live in the United States, these Terms will be governed by and construed in accordance with the laws of the state of Delaware, exclusive of its choice-of-law principles. Subject to the Arbitration Agreement in Section 2.12, you agree that exclusive jurisdiction for resolving any claim or dispute with Qustodio, or relating in any way to your use of the Services, resides in the state and federal courts located in Boston, Massachusetts, and you consent to the exercise of personal jurisdiction in those courts. Any such claims will be brought solely on an individual basis and not as part of any class, consolidated, or representative proceeding.
2. Residents outside the United States. These Terms, and any dispute arising out of or relating to them or the Services, will be governed by the laws of Spain, without regard to its conflict-of-laws rules, and the courts of Barcelona, Spain will have jurisdiction, except that, where the mandatory law of your country of residence provides that its law governs or that you may bring proceedings in the courts of your own country, that law and those courts apply. The Arbitration Agreement in Section 2.12 does not apply to you.
3. Mandatory local law. Some jurisdictions have laws requiring contracts to be governed by the mandatory provisions of the local laws of the consumer’s country or province; in such cases, those mandatory provisions apply. This Section is subject to Section 2.25.11 (Mandatory Consumer Rights; Local Law Prevails).
2.24 Survival. Upon termination, expiration, or cancellation of the Services for any reason, such terms as by their nature would survive termination shall survive. In particular, Section 2.3 (User Submissions and Feedback), Section 2.8 (Indemnification), Section 2.10 (Disclaimers; No Warranties), Section 2.11 (Limitation of Liability and Damages), Section 2.12 (Dispute Resolution by Binding Individual Arbitration), Section 2.19 (Trademark and Copyright), Section 2.20 (Account Data and Usage Data), Section 2.21 (Artificial Intelligence Features), Section 2.23 (Governing Law / Jurisdiction), this Section 2.24 (Survival), Section 2.25 (Miscellaneous), and Section 4.1 (Ownership; Proprietary Rights) will survive.
2.25 Miscellaneous.
1. Digital Millennium Copyright Act. It is Qustodio’s policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act and other applicable copyright law. We may, in our discretion, remove any material alleged to be infringing and may notify the alleged infringer.
2. Notice to California Residents. You may reach Qustodio at the contact information provided in the “Contact Us” section. California residents may also reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
3. Modification of these Terms. Qustodio may make changes to these Terms at any time and for any reason. You agree that it is your responsibility to regularly check the Services for any updated Terms. The “Last Updated” legend above indicates when these Terms were last changed. If a revision materially alters your rights, as determined by Qustodio, we will use reasonable efforts to notify you in advance of the change becoming effective. The most current version of these Terms will be posted on the Services. Changes will be effective no sooner than the Last Updated date. By continuing to use the Services after the date the changes become effective, you indicate your agreement to be bound by the updated Terms. If you do not agree to any changes, you must immediately stop using the Services.
4. Assignment. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Qustodio without restriction. Any assignment attempted in violation of these Terms shall be void.
5. Severability. If any provision of these Terms is held to be unlawful, void, or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.
6. No Waiver. The failure of Qustodio to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver will be effective only if in writing and signed by a properly authorized representative of Qustodio. Any cause of action arising out of or related to the Services by you against Qustodio must commence within one (1) year after the cause of action accrues, except where a longer period is required by applicable law.
7. Third-Party Beneficiaries. Except as expressly provided herein (including as to Apple and Google in Section 2.15), there will be no third-party beneficiaries to these Terms.
8. Law Enforcement and Public Interest. Nothing in these Terms prevents Qustodio from disclosing your information to third parties if we determine that such disclosure is reasonably necessary to: (a) comply with any applicable law, regulation, legal process, or appropriate government request; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Qustodio or our users; or (d) protect Qustodio’s rights, property, safety, or interest.
9. Interpretation. These Terms were prepared and written in English. Any non-English translations are provided for convenience only and are not valid or legally binding, except where the mandatory law of your jurisdiction requires otherwise. Use of section headings is for convenience only. The words “includes,” “including,” “such as,” “for example,” and similar terms are deemed not to limit what else might be included.
10. Entire Agreement. These Terms (including any documents incorporated here by reference) constitute the entire agreement between you and Qustodio concerning their subject matter, and they supersede any other prior or contemporaneous agreements or terms, written or oral, including any prior Qustodio terms of service.
11. Mandatory Consumer Rights; Local Law Prevails. Nothing in these Terms operates to exclude, restrict, or modify any right, guarantee, warranty, or remedy you have under the mandatory consumer-protection or other laws of your country, state, province, or region of residence that cannot lawfully be excluded, restricted, or modified by agreement (your “Mandatory Consumer Rights”). These Terms apply to you only to the extent permitted by those laws. If and to the extent any provision of these Terms (including any disclaimer of warranties, limitation of liability, indemnity, arbitration, class-action waiver, governing-law, or venue provision) conflicts with your Mandatory Consumer Rights, your Mandatory Consumer Rights prevail, and the conflicting provision applies only to the fullest extent permitted by applicable law without affecting the validity of the remaining provisions. This Section is in addition to, and does not limit, any jurisdiction-specific terms that apply to you.
Part 3. Service-Specific Terms
Your use of the Services is subject to both the General Legal Terms (Part 2) and these Service-Specific Terms. These Service-Specific Terms apply to you only if you have purchased or use one or more of the particular Services discussed below. If there is a conflict or inconsistency between the General Legal Terms and these Service-Specific Terms, the Service-Specific Terms will govern and apply. Any warranty disclaimers or limitations of liability included in these Service-Specific Terms do not limit the applicability or force of any more general warranty disclaimers or liability limitations found elsewhere in these Terms, including Sections 2.10 and 2.11.
3.1. Parental Controls. The parental controls Services (“Parental Controls”) are for parents and legal guardians to monitor and manage the internet, device, and mobile activity of their minor children, and are designed to be administered by adults on behalf of a family. If you are subscribing to the Parental Controls, you are consenting to these Terms and the applicable Privacy Policy on behalf of your own child(ren) and legal dependent(s). Information collected by Qustodio to provide the Parental Controls to you is more fully described in the Qustodio Parental Controls Privacy Policy. BY USING THE PARENTAL CONTROLS SOFTWARE, YOU EXPRESSLY AUTHORIZE QUSTODIO TO PROCESS THIS INFORMATION ON YOUR BEHALF, AND YOU INDEMNIFY QUSTODIO FROM ANY THIRD-PARTY CLAIMS, INCLUDING ANY STATE OR FEDERAL “WIRETAP” OR INTERCEPTION-OF-COMMUNICATIONS LAW CLAIMS, ASSOCIATED WITH THE COLLECTION OF THIS INFORMATION ON YOUR BEHALF.
3.2. Authorized use and consent. You may use the Services to track and monitor only your minor children or minor children for whom you are the legal guardian. You are solely responsible for determining whether, and obtaining any consent that, applicable law requires before monitoring any individual, including any notice to or consent of a monitored user where required by law. By enrolling a child, you represent and affirm that (a) you are the custodial parent or legal guardian of each minor child you register; (b) any documentation you provide asserting the same is valid; (c) each minor child you register legally resides at your address of record; and (d) you are able and willing, if requested, to provide documentation reasonably required to verify proof of parentage or legal guardianship. You agree to notify us if the status of your legal guardianship changes, and we reserve the right to cancel a child’s enrollment upon such change.
3.3. End of monitoring at adulthood. Enrollment of any child will be canceled when that child reaches the age of 18 (or the age of majority in the child’s jurisdiction, if different), as determined by the date of birth or age you provide for that child during enrollment. You are responsible for ensuring that this information is accurate and kept up to date. You agree that the Services are not to be used to monitor any individual who is 18 years of age or older except with that individual’s knowledge and consent as permitted by applicable law.
3.4. Responsibility for account and configuration. The parent or legal guardian user(s) in a plan with Parental Controls selected are solely responsible for any activity or actions in their account resulting from the use of their log-in credentials on the Services, whether or not the primary user has authorized such activities or actions.
3.5. No real-time or complete monitoring; accuracy. YOU ACKNOWLEDGE THAT THE PARENTAL CONTROLS FEATURE DOES NOT MONITOR ALL CONTENT OR YOUR CHILD’S BEHAVIOR IN REAL TIME. ALERTS AND/OR INSIGHTS MAY NOT BE 100% ACCURATE OR TIMELY. ANY INFORMATION OBTAINED THROUGH YOUR USE OF THE PARENTAL CONTROLS IS DELIVERED TO YOU FOR YOUR USE AT YOUR OWN DISCRETION AND RISK. NO ADVICE, RESULT, INFORMATION, OR MATERIAL, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU THROUGH THE PARENTAL CONTROLS SHALL CREATE ANY WARRANTY OR REPRESENTATION BY QUSTODIO. Where the Parental Controls rely on AI Features, the additional terms and disclaimers in Section 2.21 also apply.
3.6. Content filtering and false positives. You further acknowledge that Qustodio does not guarantee that content you deem objectionable will be unavailable at all times or at any time. You assume full risk and responsibility for the use of or reliance on the Parental Controls as regards content blocking. “False positive” content blocking may occur from time to time. We strive to allow sufficiently granular control of content filters to allow educational or meritorious content through where that is the intent of the user; however, there is no guarantee that some content you would deem acceptable will not be blocked. If you believe we are miscategorizing a site or service, please contact us at support@qustodio.com to submit the issue for review.
3.7. Device management, profiles, and anti-uninstall. To provide certain functionality (including preventing removal of the Software and enabling device management), Qustodio may offer a device-management tool or configuration profile that you install on a monitored device. To use it, you will follow the instructions provided by Qustodio to create a profile for each device and to enable Qustodio to manage the device on your behalf. This profile allows us to monitor the usage of the device and to set up, erase, restore, and manage configurations of the device in accordance with your instructions on the dashboard, and to help prevent removal of the Software. BY INSTALLING THIS TOOL AND SETTING QUSTODIO AS DEVICE MANAGER, YOU AUTHORIZE QUSTODIO TO MANAGE THE DEVICE ON YOUR BEHALF. You represent that you have the authority to place the device under management and to grant these permissions.
3.8. iOS devices; network configuration and notifications. Upon installation of the Software on a device using the iOS operating system, due to the technical configuration of the system, data transmitted to and from the device may be channeled through our servers, such that we may be visible to third parties such as your internet access provider. Although we are not an internet access provider, due to this configuration we may receive notifications from third parties regarding a monitored user’s online behavior. If we receive such a notice stating that a monitored user is engaged in activity that is or may be illegal or that violates the rights of third parties, or if we reasonably believe any activity is or may be detrimental to the provision of the Services, we may (and will, where obliged by court order or applicable law or to protect our interests): (a) suspend or block the device’s access to the internet or to certain websites or internet services; (b) provide the notifying party, a court, or a public authority with your name and contact details; and/or (c) terminate your account. YOU CONSENT TO THE DISCLOSURE OF YOUR CONTACT DATA FOR THIS PURPOSE. We will endeavor to notify you before suspending your access or providing such data to any third party, except where prohibited by law.
3.9. Device and user allowances. The number of devices and users you may enroll, and the features available to you, are governed by your Service Entitlement and License Entitlement (see Part 4) as specified at the time of purchase and in your account profile and within the Services. We may review account usage that appears inconsistent with personal, non-commercial family use, and take action consistent with these Terms.
PRECAUTIONS:
THE PARENTAL CONTROLS ARE NOT A MEDICAL DEVICE, AND YOU EXPRESSLY AGREE THAT THE SERVICES DO NOT INVOLVE THE PROVISION OF MEDICAL ADVICE BY QUSTODIO. THE SERVICES ARE NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. THE SERVICES ARE FOR INFORMATIONAL PURPOSES ONLY AND CANNOT REPLACE THE SERVICES OF PHYSICIANS OR MEDICAL PROFESSIONALS.
THE PARENTAL CONTROLS, INCLUDING ALL INFORMATION, TEXT, PHOTOGRAPHS, IMAGES, ILLUSTRATIONS, GRAPHICS, AUDIO, VIDEO, AND OTHER MATERIALS, WHETHER PROVIDED BY US OR THIRD PARTIES, ARE NOT INTENDED TO BE AND SHOULD NOT BE USED IN PLACE OF (A) THE ADVICE OF YOUR PHYSICIAN OR OTHER MEDICAL PROFESSIONALS, OR (B) A VISIT, CALL, OR CONSULTATION WITH YOUR PHYSICIAN OR OTHER MEDICAL PROFESSIONALS.
SHOULD YOU HAVE ANY HEALTH-RELATED QUESTIONS REGARDING YOUR CHILD, PLEASE CALL OR SEE YOUR CHILD’S PHYSICIAN OR OTHER MEDICAL PROVIDER PROMPTLY. SHOULD YOU HAVE AN EMERGENCY, CALL YOUR PHYSICIAN OR YOUR LOCAL EMERGENCY NUMBER IMMEDIATELY. YOU SHOULD NEVER DISREGARD MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF ANY INFORMATION PRESENTED THROUGH THE SERVICES, AND YOU SHOULD NOT USE THE SERVICES FOR DIAGNOSING OR TREATING A HEALTH PROBLEM. THE TRANSMISSION AND RECEIPT OF THE SERVICES, IN WHOLE OR IN PART, OR COMMUNICATION VIA THE INTERNET, EMAIL, OR OTHER MEANS DOES NOT CONSTITUTE OR CREATE A DOCTOR-PATIENT, THERAPIST-PATIENT, OR OTHER HEALTHCARE PROFESSIONAL RELATIONSHIP BETWEEN YOU AND QUSTODIO.
Part 4. Limited License
We are pleased to grant you, an individual user, a personal, non-transferable, non-exclusive, term-limited, and revocable license to install and use the Software and access the Services for which you have purchased a Subscription for personal use on the number of Devices (defined below) and for the number of users specified in your License Entitlement or Service Entitlement, as applicable, subject to the System Requirements.
“License Entitlement” means the number and type of Devices and users that are permitted to download and use the Software and access the Services, as specified at the time of purchase and in your account profile and within the Services. If no licensed device count or user count was specified, the License Entitlement is for a single Device and user.
“Service Entitlement” means the scope and duration of the Services you purchased, as specified at the time of purchase and in your account profile and within the Services. If no scope or duration is specified, the Service Entitlement is for a single Device and user for one year.
“System Requirements” means the supported Devices and operating systems that the particular Qustodio product or service you purchased will function properly with, as listed on our website or other applicable documentation. It is your responsibility to meet System Requirements, such as obtaining updates or upgrades to continue using the Services.
4.1 Ownership; Proprietary Rights. The Services, including the Software (and any releases, revisions, updates, or enhancements), and all of their content, features, and functionality, including, without limitation, information, text, graphics, logos, button icons, images, visual interfaces, audio and video clips, data compilations, computer code (including source code or object code), software, products, services, and the design, selection, and arrangement thereof, and any accompanying documentation (collectively, the “Materials”), are the exclusive property of Qustodio, its licensors, or other content suppliers, and are protected by United States and international copyright, trade dress, patent, and trademark laws, conventions, and other relevant intellectual property and proprietary rights laws. Except as expressly authorized by Qustodio, you agree not to sell, license, distribute, copy, modify, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of any of the Services or Materials. Qustodio reserves all rights not expressly granted in these Terms.
4.2 Limited License. Subject to these Terms, Qustodio grants you a limited, revocable, non-exclusive, personal, non-transferable license to install and use the Software and to access the Services for internal, non-commercial, and personal purposes only, and subject to your Service Entitlement and License Entitlement. The Software is “in use” on a Device when it is loaded into temporary memory (e.g., RAM) or installed into permanent memory (e.g., hard disk or other storage device) of the Device.
4.3 License Restrictions. You may not (and may not allow a third party to):
1) reverse engineer, decompile, disassemble, or attempt to reconstruct, identify, or discover any source code, underlying ideas, underlying user interface techniques, or algorithms of the Services by any means whatsoever, except to the extent that such restriction is expressly prohibited by applicable law;
2) remove or destroy any copyright notices or other proprietary markings from the Services;
3) remove, circumvent, disable, damage, bypass, or otherwise interfere with any security-related features of the Services, any features that prevent or restrict use or copying of the Software, any features or measures that enforce limitations on, or prevent or restrict access to or use of, the Services, or any other use restrictions applicable to the Services;
4) modify or adapt any aspect of the Services, merge any aspect of the Services into another program, or create derivative works based on the Services;
5) use, copy, or distribute the Software without Qustodio’s written authorization, except that you may make one (1) copy of the Software for archival or backup purposes only;
6) use the Services to provide, alone or in combination with any other software, product, or service, any product or service to any person or entity, whether on a fee basis or otherwise;
7) repackage, modify, adapt, tamper with, alter, translate, or create derivative works of the Services or any aspect thereof;
8) combine or merge any part of the Services with or into any other software, or use the Services as part of an effort to develop software having functional attributes, visual expressions, or other features similar to those of the Services or to compete with Qustodio;
9) except with Qustodio’s prior written permission, publish any performance or benchmark tests or analysis relating to the Services; or
10) rent, lease, sublicense, sell, assign, loan, use for timesharing or service bureau purposes, or otherwise transfer the Services or any of your rights and obligations under these Terms.
4.4 Open Source. The open-source code components included with the Software are redistributed by Qustodio under the terms of the applicable open-source license for such components. If there is an inconsistency between an open-source license and these Terms, the open-source license controls with respect to the applicable component. Your receipt of open-source components from Qustodio under these Terms neither enlarges nor curtails your rights or obligations defined by the applicable open-source license.
4.5 Availability. You may use the Software solely to access the Services. A computer or other equipment enabled to access the internet (a “Device”) is required to utilize the Services. You are solely responsible for ensuring that your Device is sufficient and compatible for use with the Services and complies with all System Requirements. The speed and quality of the Services may vary, and the Services are subject to unavailability, including emergencies, third-party service failures, transmission, equipment, or network problems or limitations, interference, signal strength, and maintenance and repair, and may be interrupted, refused, limited, or curtailed.
4.6 Termination. Upon expiration or any termination of these Terms, you must stop using the Services and destroy all copies of the Software and any associated documentation in your possession.
Part 5. Additional Terms for EU, EEA, and UK Residents
If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, the following additional terms apply to your use of the Services and supersede any conflicting provisions in the General Legal Terms (Part 2) or elsewhere in this agreement.
5.1 Governing Law and Jurisdiction.
These Terms, and any dispute arising out of or relating to them or the Services, will be governed by the laws of Spain, without regard to its conflict-of-laws rules, and the courts of Barcelona, Spain will have jurisdiction. However, where the mandatory law of your country of residence provides that its law governs or that you may bring proceedings in the courts of your own country, that law and those courts apply. The Arbitration Agreement and Class Action Waiver in Section 2.12 do not apply to you.
5.2 Statutory Right of Withdrawal (Cooling-Off Period).
You have a statutory right to withdraw from your purchase of a paid Subscription, without giving any reason, within fourteen (14) days beginning on the day the contract is entered into. To exercise this right, you must inform us of your decision to withdraw by a clear statement before the 14-day period expires, using the contact details in Section 2.22 (Notices; Contact Us) or the process described at [insert link to withdrawal information / model form]. You may, but are not required to, use a model withdrawal form. If you asked us to begin providing paid-up Services during the 14-day period and you then withdraw, you must pay for the portion of the Services provided up to the time you inform us of your withdrawal, and we will refund the balance. Nothing in these Terms limits any additional or more favorable cancellation or refund rights available to you under the mandatory law of your country of residence.
If you subscribe to a plan that includes a free trial, you retain your statutory right of withdrawal for fourteen (14) calendar days from the date of first subscription (meaning the day of acceptance of these Terms for the free trial), without prejudice to your additional right to cancel the subscription during the first thirty (30) days, as provided in Clause 2.17.
5.3 Dispute Resolution.
If your complaint cannot be resolved satisfactorily through our customer service, you may contact the relevant consumer protection agencies and consult the accredited alternative dispute resolution entities, including Consumer Arbitration Boards established for this purpose in your country. In Spain, you can view the list of accredited entities and how to contact them on the website of the Ministerio de Derechos Sociales, Consumo y Agenda 2030. Qustodio is not affiliated with any alternative consumer dispute resolution body and participation in a consumer arbitration proceeding will require its consent, unless there is a legal obligation to participate. The foregoing does not limit your right to bring a claim before the competent courts and tribunals.
5.4 Mandatory Consumer Rights.
Nothing in these Terms operates to exclude, restrict, or modify any right, guarantee, warranty, or remedy you have under the mandatory consumer-protection or other laws of your country, state, province, or region of residence that cannot lawfully be excluded, restricted, or modified by agreement. If and to the extent any provision of these Terms (including any disclaimer of warranties, limitation of liability, indemnity, arbitration, class-action waiver, governing-law, or venue provision) conflicts with your mandatory consumer rights, your mandatory consumer rights prevail.
5.5 Cancellation for EU consumers.
1. Cancellation by Qustodio. Notwithstanding Section 2.17.1, Qustodio may only terminate your Subscription before the end of the current Subscription period in the event of a material breach of these Terms by you or for serious reasons beyond the parties’ control that justify such termination. Qustodio will provide you with reasonable prior notice, unless immediate termination is justified by the circumstances. If Qustodio terminates your Subscription early, you will be entitled to a refund of any prepaid fees corresponding to Services not provided, without prejudice to any other rights under applicable law.
2. Cancellation by You. Notwithstanding Section 2.17.2, you may cancel your Subscription at any time, with cancellation taking effect at the end of the current Subscription period, unless earlier termination is permitted under applicable law. Any applicable refund rights will be governed by these Terms and applicable law.
In the event of any conflict between this Section and Section 2.17, this Section shall prevail for EU consumers.
